This website is owned by Open Space. Please refer to the following for our Terms and Conditions. These Terms of service comprises the entire agreement between you and Open Space and supersede all prior agreements between the parties regarding the subject matter contained herein. We reserve the right to pursue any amounts you fail to pay in accordance with these Terms.

General

The given Terms and Conditions applies in the trading of all the products and services offered by Open Space. In the following Terms and Conditions Open Space, is also referred as “we”, “our” or “us”. Our “Normal working hours” are 24 hours and 7 days and our “Working days” are Monday to Sunday. These Terms and Conditions prevail over any other negotiations done or on assumption by the other trader unless otherwise done in writing and notified/legalised by both the parties. Any changes in the given Terms and Conditions shall be done in writing and officially approved by the concerned personnel of Open Space. In the event of invalidation of any of the clauses given below the other clauses shall not lose its validation. Please review our separate privacy policy details of how we handle personal information of the Users. Open Space at its discretion may record the telephonic conversations/emails/transactions for staff training and quality control purposes so as to continually improve our services and products offerings. These Terms and Conditions do not in way affect your constitutional rights.

Fees

You are responsible for the timely payment of all fees and charges you may incur in connection with the use of all services. For any payment due to Open Space, Open Space may charge a late fee equal to the lesser of one and one-half percent (1.5%) per month or the maximum amount permitted by law on unpaid balances if your account becomes past due. You may also be responsible for collection costs incurred by Open Space to obtain payment from you including reasonable attorneys’ fees. Payments due to third parties shall be subject to the applicable terms and conditions between you and the third parties.

Lost or damaged products

By using our services, you agree that in the event that a handbag is lost or returned in a condition that exceeds normal wear, Open Space may bill to users of service the replacement cost applicable to such product. Each product is subject to its own individually priced replacement fee, which will be set by Open Space, in our sole discretion. In the event Open Space determine, in its sole discretion, that the relevant product is capable of being repaired or restored to its original condition (fair wear and tear excepted), Open Space may charge the users of service a lesser amount in place of the applicable replacement fee.

If you return the product(s) later than your scheduled return date, a late fee of up to half (50%) of your rental fee will be charged to the payment card you used to pay the rental fee, to any other payment card included in your account information that you have provided to Open Space or to you, for every day that you are late in returning the product. You agree to pay such late fees, up to the amount equivalent of 7 days of late fee. The late fee is payable for each order of product that is not returned when due, including its parts, not for each product that is the subject of the order that is late.

If you fail to return the Product and its parts for 7 calendar days or more, your late return will be considered a non-return, and Open Space will charge you or your payment card the maximum late fee. Open Space will still expect you to return the product or Open Space have the rights to create a police report, considering it as theft.

Open Space reserves the right to request for items to be returned to us at any point in time. Failure to receive items on time will give us the rights (at law and/or otherwise) to claim for the product(s) up to the full retail price or fair value of goods, whichever higher. You will not be entitled to any refund of rental fees. If you fail to return the Product at our stipulated time, Open Space have the rights to create a police report, considering it as theft.

Open Space supports the great importance of law and is committed towards complying with it. We deem adherence of our legalities as an important part of our trade. You agree to use the site only for lawful purposes and in a manner which does not infringe or contradict with the rights of use or enjoyment of another user of the site. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), contained on the Site is owned, controlled or licensed by or to Open Space.

The risk associated to website

Open Space is not liable in the event of any substantial loss of data, loss of profit, site breakdowns or any other particular damage while using our website or downloading data from our web-address. It is solely your liability to ensure that any information downloaded from our website is virus-free.
